By accessing or using VidMyPic ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

VidMyPic provides AI-powered tools for generating images and videos from text prompts and uploaded images. The Service uses third-party AI models and services to process user inputs and generate content.

3. User Responsibilities and Content Guidelines

3.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Generate content that violates any applicable laws or regulations
• Generate content depicting minors in any inappropriate, suggestive, or explicit context
• Generate content that infringes on intellectual property rights of others
• Generate content that harasses, threatens, or defames any person or entity
• Generate deepfakes or manipulated content intended to deceive or defraud
• Generate content for spam, phishing, or malicious purposes
• Attempt to reverse engineer, hack, or compromise the Service

3.2 NSFW Content

The Service offers an optional NSFW (Not Safe For Work) content generation feature for users who are 18 years of age or older. By enabling NSFW content generation, you represent and warrant that:

• You are at least 18 years of age
• You will use this feature only for personal, lawful purposes
• You will not generate content depicting minors in any context
• You will not generate content that violates any laws in your jurisdiction
• You understand that you are solely responsible for any content you generate

WARNING: VidMyPic implements content safety filters, but no AI system is perfect. You are solely responsible for ensuring that your prompts and generated content comply with all applicable laws.

3.3 Content Ownership and Rights

You retain ownership of content you upload to the Service. By uploading content, you grant VidMyPic a non-exclusive, worldwide license to process, store, and display your content solely for the purpose of providing the Service. Generated content is provided to you for your use, subject to these Terms.

4. Disclaimer of Warranties and Limitation of Liability

4.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

4.2 AI-Generated Content Disclaimer

VidMyPic uses third-party AI models to generate content. We make no representations or warranties regarding:

• The accuracy, quality, or appropriateness of generated content
• The absence of offensive, harmful, or inappropriate content in outputs
• The suitability of generated content for any particular purpose
• The absence of copyright, trademark, or other intellectual property infringement in generated content

4.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIDMYPIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any content generated by the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

YOU ACKNOWLEDGE AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ALL CONTENT YOU GENERATE USING THE SERVICE, AND VIDMYPIC BEARS NO RESPONSIBILITY OR LIABILITY FOR YOUR USE OR MISUSE OF GENERATED CONTENT.

5. Indemnification

You agree to indemnify, defend, and hold harmless VidMyPic, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party, including intellectual property rights
• Content you upload or generate using the Service
• Your distribution or publication of generated content

6. Payments, Subscriptions, and Billing

6.1 Payment Processing

VidMyPic uses Stripe for payment processing. All payments are processed securely through Stripe's payment infrastructure. By making a purchase, you agree to Stripe's terms of service and privacy policy.

6.2 Subscription Cancellation

You may cancel your subscription at any time through your account settings or by contacting customer service. Upon cancellation:

• Your subscription will remain active until the end of your current billing period
• You will continue to have access to all features until the subscription expires
• No further charges will be made after the current billing period ends
• You may reactivate your subscription at any time

6.3 Refund Policy

VidMyPic provides digital services (AI-generated content). Due to the immediate nature of digital content delivery:

• Gems and One-Time Purchases: All gem purchases and one-time content generation fees are final and non-refundable, as the service is provided immediately upon purchase.
• Subscription Refunds: Subscription fees are non-refundable. However, if you cancel your subscription, you will not be charged for future billing periods.
• Service Failures: If a paid generation fails due to technical issues on our end, we will automatically refund the gems used or provide credits equivalent to the amount charged.
• Disputes: If you believe you were charged incorrectly, please contact our customer service team. We will investigate and resolve disputes within 30 days.

6.4 Return Policy

VidMyPic provides digital services only. We do not sell physical goods, therefore traditional return policies do not apply. All sales of digital content generation services are final. If you experience technical issues with the service, please contact customer service for assistance.

7. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

8. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We also reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10. Age Restriction

You must be at least 13 years of age to use the Service. Users under 18 years of age may not use the NSFW content generation features. By using the Service, you represent and warrant that you meet these age requirements.
